MAY 19, 2017 – Marc Roth has joined the Advertising, Marketing, and Promotions practice of Davis Wright Tremaine as a partner in the New York office.
 
Mr. Roth is nationally recognized for his expertise in advising clients on the laws regulating the advertising and marketing of products and services and for his advocacy in defending companies before federal and state regulators. He advises clients across numerous industries on subjects such as privacy, social media, sweepstakes, email and mobile marketing, telemarketing, and advertising content and strategy.

Mr. Roth comes to the firm from Manatt, Phelps & Phillips, where he was a partner since 2010. Prior to joining Manatt, he spent 5 1/2 years as a staff attorney with the FTC and held in-house positions at several companies, including a Time Warner subsidiary, where he was responsible for marketing and advertising compliance.

Mr. Roth advises his clients on numerous cutting-edge issues, such as the collection and use of personal information in marketing campaigns and the development and management of free trial, negative option, and continuity marketing programs. In addition to his counseling work, he has represented clients before federal and state regulatory authorities (including the FTC, the FDA, the FCC, and states attorneys general) and Better Business Bureaus in responding to complaints, inquiries, investigations, subpoenas, and Civil Investigative Demands.

His depth of experience in consumer protection law also includes founding and chairing a 15-person Telephone Consumer Protection Act practice group at Manatt. He will collaborate closely with Davis Wright Tremaine’s TCPA and class action defense teams to support clients in this area, which continues to generate significant growth in class action litigation.

A frequent author and speaker, Mr. Roth was named a 2017 Top Author by JD Supra, recognizing him as one of the five most-read lawyers on the subject of class action defense. He chair’s the annual Practising Law Institute program, TechLaw: The Digital Evolution, and develops and conducts personalized CLE programs for clients.

Mr. Roth received a B.A. from Hobart College, an M.A. from the Maxwell School of Citizenship and Public Affairs at Syracuse University, and a J.D. from Syracuse University College of Law.  He is ranked, along with Ms. Felsten and DWT’s Robert Driscoll, as a national leader in advertising law by Chambers USA.
