| Boris Gaviria is a labor and employment attorney with an emphasis on litigation. He regularly defends employers against claims of race, gender, and other forms of discrimination, including sexual harassment, and litigates wrongful discharge and class action cases as well as general commercial litigation. Boris is fluent in Spanish and active in civic organizations. Selected Experience Obtained a full defense verdict for our client after a weeklong jury trial in federal court. The case involved allegations of violations of the ADA, WLAD, FMLA, and public policy. (2009) Represented the Seattle Art Museum in a race and national origin case brought by a terminated employee. The federal court granted summary judgment in all respects. On appeal, the 9th Circuit affirmed the dismissal. (2009) Represented defendant in a whistleblower retaliation case in which plaintiff alleged wrongful, constructive discharge in violation of public policy. Motion for summary judgment was granted and case against our client was dismissed. (2009) Summary judgment for client in case involving former employees' claims of breach of contract. (King Cnty. (Wash.) Super. Ct. 2008) Defended residential drywall contractor in wage and hour class action litigation involving alleged underpayment of wages and overtime. Case settled after discovery, motion practice and court-ordered mediation. (2008) Defended an employer in the largest wage and hour class action in Washington history.
