Settled favorable to client; related title insurance claim pending. JA Investments LLC v. Oak Grove Theater Company (Clackamas Cnty. (Or.) Cir. Ct. 2008) Obtained settlement in recovery of insurance proceeds in a state and federal Superfund environmental claim. (Cal. P.U.C. 2008) Defended cattle ranchers in Endangered Species and National Forest Management Act claims challenging a cattle grazing permit on Fremont-Winema National Forests; plaintiff's case was dismissed. (D. Or. 2007) Response to claims of asbestos in homeowners' soil at former marine base developed by client. Successfully litigated to obtain insurance coverage and indemnity. 03-CV-637-CO (2006) Representation of the defendants against claims involving alleged asbestos contamination of a housing development and related enforcement action brought by the EPA and related insurance coverage claims against multiple carriers. (Bankr. D. Or. 2006) Livestock trespass claim by BLM resolved as inadvertent trespass. (2006) Successfully represented property owner in federal quiet title action to defeat U.S. government's challenge to title. 04-CV-489-KI (D. Or. 2005) Representation in trial and appellate courts of plaintiff representing a class of approximately 150 cattle ranchers over uses relating to grazing leases on state lands. Resolved in Oregon Supreme Court with a favorable result and settlement. (Or. 2005) Defended a fisheries consultant in an Endangered Species Act and Clean Water Act claim and related insurance coverage. Insurance carrier resolved claim on behalf of client.
