Selected Experience Represented Ocean Express Trading in dispute with South Korean fish buyer. Successfully compelled Korean buyer to arbitrate in Seattle. (W.D. Wash. 2011) Represented national wireless carrier in cases involving enforceability of agreements to arbitrate on an individual basis, including issues of pre-emption by Federal Arbitration Act. 2008 WL 510401 & 512 F.3d 1213 (9th Cir. 2008) Represented client in AAA fee dispute arbitration in Boston. (2007) Analyzed and prepared claim for International Chamber of Commerce arbitration. Claims settled successfully before filing. (2007) Defended client in $38 million breach of contract case arising from arbitration (in which a complete defense award was obtained; the plaintiff then sought a trial de novo in court) and obtained a favorable settlement. (S.F. Cnty. (Cal.) Super. Ct. 2007) Represented owner in claims against contractor and architects for defects in Seattle mixed-use building. Successfully settled in mediation before American Arbitration Association. No. 03-2-34870-8SEA (King Cnty. (Wash.) Super. Ct. 2007) Successfully represented defendant technology company in an arbitration of claims by a former manager that he was entitled to bonuses and back salary. The arbitrator ruled in favor of the defendant on all claims. (2007) Defended breach of contract and intentional interference action against manufacturer of construction equipment. Successfully enforced arbitration provision requiring the suit to be filed in Singapore, eventually leading to the dismissal of case. (2007) Compelled World Intellectual Property Organization (WIPO) arbitration (London) for client in software license dispute. Order for dismissal without prejudice; plaintiff's motion for reconsideration denied by court order. (2007) Successfully represented defendant in a jury trial regarding the enforceability of an arbitration agreement with an employee. Obtained a jury verdict in favor of the defendant enforcing the arbitration agreement. 05-2-20617-9-KNT (King Cnty. (Wash.) Super. Ct. 2006) Section 251/252 arbitration of fiber meet point interconnection terms. DTE 06-56 (2006) Multi-party interconnection arbitration proceeding implementing TRO and TRRO UNE amendments. Substantially prevailed after three-week hearing before panel of three arbitrators. (2005) Section 251/252 interconnection arbitration proceeding against SBC/AT&T in Missouri. Case No. TO-2005-0336 (8th Cir. 2005) Represented independent power producer in binding arbitration against major Southern California utility in dispute arising under 470 MW power purchase agreement.
