Davis Wright Tremaine served as project counsel in connection with the development and construction of the Harvest Wind Project, a 98.9 megawatt wind generating facility located in Klickitat County, Wash. The Harvest Wind Project achieved commercial operation on Dec. 15, 2009, and is comprised of 43 Siemens 2.3 MW wind turbines. The project is owned as a tenancy-in-common comprised of Public Utility District No. 1 of Cowlitz County, Wash.; the Eugene Water & Electric Board; Lakeview Green Energy, Inc. (a wholly owned subsidiary of Lakeview Light & Power, an electric cooperative based in Lakewood, Wash.); and Peninsula Light Co. (an electric cooperative based in Gig Harbor, Wash.).
We represented the Harvest Wind Project in all aspects of its related transactions, including the following: (1) wind leases, easements and other real estate matters; (2) the joint ownership arrangements; (3) turbine supply and balance of plant construction contracts; (4) power sales agreements; (5) interconnection and transmission agreements with the local public utility district and the Bonneville Power Administration; (6) the operation and maintenance agreement and turbine service agreement.
