Joseph E. Addiego III is a partner in the
San Francisco, California office of Davis Wright Tremaine and is one
of three original members of its litigation department. Concentrating
his practice in the areas of Internet and eCommerce, intellectual
property and commercial litigation, Mr. Addiego has represented large
corporations, start-up companies, partnerships, professionals, banks,
hospitals and individuals in a wide variety of disputes in both state
and federal court. Representative matters that Mr. Addiego has handled
include the following:
- Internet Domain Name Dispute - recently resolved a dispute regarding ownership rights to 107 domain names, including a high profile fashion-related domain;
- Computer Software Litigation - recently served on trial team representing the State of California against a contractor for a failed $100 million software development project, included the direct examination at trial of former California Governor Pete Wilson's Chief of Staff;
- Copyright Infringement - recently resolved a copyright infringement case brought against a publisher over the alleged unauthorized use of photographs of a famous individual;
- Patent Infringement - prosecuted case on behalf of patent holder for insulated beverage container, ultimately leading to a licensing agreement with the infringer;
- Trademark Infringement - successfully defended a trademark suit brought by a multi-national fast food chain, ultimately forcing the plaintiff to pay defendant to settle.
Mr. Addiego also has an active Internet and eCommerce practice. Mr. Addiego has advised clients and handled disputes regarding website and domain name usage, development, production and sale, as well as related intellectual property issues. Mr. Addiego also has assisted clients with web site design and related issues, including the negotiation of agreements, the preparation of privacy and terms of use policies, and website reviews. Mr. Addiego is an active member of DWT's Internet & eCommerce practice group and presently is responsible for re-designing the firm's Internet & eCommerce website.
A graduate of Pomona College in Claremont, California, Mr. Addiego received his J.D. from Santa Clara University School of Law, where he was a comments editor for the Santa Clara Law Review. Mr. Addiego also published his own article, "FIRREA Disrupts Traditional Notions of Attorney Duty By Exposing Lawyers, as Institution-Affiliated Parties, to Personal Liability," in the Santa Clara Law Review, Vol. 33, No. 4.
Mr. Addiego is a member of the State Bar of California and is admitted to practice in California, the U.S. District Court, Northern, Central and Eastern of California, and the U.S. Court of Appeals, Ninth Circuit. Addiego is a member of the Bar Association of San Francisco's Intellectual Property section, the Alameda County Bar Association and the American Bar Association's litigation section.
