Representative Experience
Stuart Dunwoody litigates patent, trademark, copyright, trade secret and marketing disputes. Representative cases include:

ProteoTech, Inc. v. Unicity International, Inc., U.S. District Court, Western District of Washington (2006-present). Represent plaintiff in action for infringement of patents for use of plant extract in treatment of Alzheimer’s disease, and related trademark infringement claim.

Choongwae Pharma Corporation v. Kahn and Institute for Chemical Genomics, U.S. District Court, Western District of Washington (2005-07). Represent defendant biotech research institute in dispute over ownership of patents and misappropriation of trade secrets. Successfully settled.

PotatoFinger, Inc. v. Snack Alliance, Inc., U.S. District Court, Northern District of Georgia (2006-07). Defeated motion for preliminary injunction in trade dress dispute over design of packaging for potato chips.

HomeStreet, Inc. v. HomeStone Mortgage, Inc., U.S. District Court, Western District of Washington (2006-07). Representation of plaintiff bank in dispute over trademark infringement of "HomeStreet Bank" mark by "HomeStone Mortgage." Successfully settled.

Dibbs v. The Franklin Mint, U.S. District Court, Western District of Washington (2006- present). Representation of defendant in copyright infringement dispute concerning use of photographs.

Guthy-Renker Corporation v. Coluccio, U.S. District Court, Central District of California (2006-07). Represented defendants against trademark infringement claims arising from use of plaintiff’s "Proactiv" trademark as keyword to trigger ads on Google, and related false advertising and copyright infringement claims. Successfully settled.

Trinity Glass International, Inc. v. Burns, Morris & Stewart, L.P., U.S. District Court, Western District of Washington (2004-2005). Obtained summary judgment of patent non-infringement after obtaining more favorable claim construction than in previous litigation on same patent.

Cassirer v. Kingdom of Spain, U.S. District Court, Central District of California (2005-present). Represent Holocaust survivor in action to recover painting stolen by Nazis in 1939.

RUI One Corp. v. Cutters Point, Inc., U.S. District Court, Western District of Washington (2006-07). Represented defendant in trademark infringement dispute over use of "Cutters" mark for coffee and restaurant services; successfully settled.

Representation of Broadcast Music, Inc., U.S. District Court, Eastern and Western Districts of Washington (2001-2007). Representation of BMI in numerous infringement actions against establishments performing music without a BMI license.

Northland Communications Corporation v. MTV Networks, U.S. District Court, Western District of Washington (2005 - 2006). Prosecution of copyright infringement counterclaims by MTV Networks against operator of cable systems for transmitting cable programming without authorization.

Seattle Gourmet Foods, Inc. v. The Bon, Inc., King County Superior Court and U.S. District Court, Western District of Washington (2003-2004). Represented manufacturer of chocolates in action involving trade dress, trademark, false advertising trade secret and copyright claims. Successfully settled.

Darryl Lemon v. Prince Rogers Nelson, U.S. District Court, Western District of Washington (1997–2000). Defended Prince and Warner Bros. Records in action alleging that Prince’s song “I Hate U” infringes plaintiff’s unreleased song.

Amazon.com, Inc. v. The New York Times Co., U.S. District Court, Western District of Washington (1999). Represented New York Times in dispute over Amazon.com’s use of the New York Times Best Seller list. Case settled.
