Creditor's Rights Litigation
A broad spectrum of creditor's rights litigation in state and federal court, including litigation in multi-million dollar secured loans
Disputes involving the Uniform Commercial Code, collateral priority lawsuits, collateral recovery, disposition and valuation
Personal property finance lease litigation, fraudulent transfer claims, lien claims and a variety of complex collection matters
Advising clients on creditor's rights, leasing, retail and wholesale financing matters
Bankruptcy court experience includes a wide range of litigation in multi-million dollar secured and unsecured claims litigation
Automatic stay relief and lease assumption/rejection matters, prosecution and defense of involuntary bankruptcy petitions and nondischargeability proceedings, trustee disputes, preference and fraudulent transfer claims and a variety of other contested matters and adversary proceedings
Experience in Chapter 7, 11, 12 & 13 cases
Real Property Disputes
Broad litigation experience in real estate purchase and sales disputes, Landlord-Tenant Act (commercial and residential) disputes, title problems, partition of jointly owned properties, quiet title and ejectment actions involving large commercial properties, construction contract and lien litigation, adverse possession lawsuits, boundary disputes and land use and real estate development disputes
Probate and Trust Disputes
Prosecuted and defended multi-million dollar will contest cases (undue influence and competency), Judicial Proceedings under Washington's Trust & Estates Dispute Resolution Act, probate administration disputes, trust administration disputes, community and separate property treatment claims and creditor's claims in probate
Valuation and other disputes on behalf of administrators, trustees and other fiduciaries and beneficiaries
Business Organizations
Representation in multi-million dollar lawsuit under the Revised Uniform Partnership Act for dissolution, accounting, breach of fiduciary duties and other claims
Several franchisor-franchisee lawsuits, including a multi-million dollar dispute under the Franchise Investment Protection Act
Lawsuits for dissolution of corporations and disputes of dealership, distributorship and representative agreements, involving trade secrets issues
Other
Primary contact for several national asset-based lenders and finance companies, a regional and local real estate developer, property owners, retail business landlords and tenants, contractors and local business owners
Contact for senior finance and credit officers of finance institutions, retail companies and businesses as well as individuals
Regular pro bono representation in family law and other matters
Prior Experience
Senior Officer, Seattle-First National Bank (Bank of America), managing a unit of the internal audit department that handles a wide variety of the bank's financial and operational functions, including cash management and funds transfer
