Areas of Practice
Energy regulation, with emphasis on the Federal regulation of electric transmission and sales, Regional Transmission Organizations, licensing and regulation of hydroelectric projects, practice before the Federal Energy Regulatory Commission (FERC), and compliance with mandatory electric reliability standards subject to the oversight of the North American Electric Reliability Corporation (NERC).

Representative Experience
Mr. Gish has more than 25 years’ experience dealing with a wide variety of energy issues as a practitioner with major Washington, D.C. law firms, and in positions of responsibility with the FERC. During this time, Mr. Gish addressed numerous issues involving the electric, hydroelectric, and natural gas industries before administrative agencies and the courts.

Since joining DWT in 2001, Mr. Gish has been involved with representing independent power producers, including wind energy generators, with respect to FERC policy initiatives, transmission and interconnection matters, market-based rates, approvals for acquisition and disposition of assets, and other issues.

Mr. Gish has also represented merchant transmission line developers with respect to securing necessary FERC approvals. In addition, Mr. Gish has represented hydroelectric licensees with respect to obtaining and amending licenses and challenges to license conditions, and has advised clients with respect to compliance with mandatory electric reliability standards proposed by NERC and approved by the FERC.

Prior to joining DWT, Mr. Gish was a Managing Attorney in the Office of General Counsel at the FERC, where he supervised a group of attorneys responsible for drafting FERC orders and generally advising the Commissioners.

While at the FERC, Mr. Gish was team leader for the staff team that drafted FERC’s Order No. 2000 on Regional Transmission Organizations. He also drafted a number of other FERC orders on electric matters, such as market-based rates, transmission, and mergers.

Publications and Presentations
Mr. Gish made numerous presentations while at the FERC about the Regional Transmission Organizations rulemaking. He also met with various international delegations explaining the U.S. system of electric regulation. He authored several articles dealing with the early stages of electric restructuring. (“FERC’s Mega-NOPR: The IOUs Respond,” Public Utilities Fortnightly (March 1, 1996); “Electric Industry Restructuring: The States Forge Ahead,” Public Utilities Fortnightly (Oct. 1, 1995)). Mr. Gish also authored an article addressing FERC’s Order No. 890. (“Third Time the Charm for Unbiased Open Access?” Power (July 2007)).
