Representative Experience
Mr. Isola practices in Davis Wright Tremaine’s commercial litigation and credit recovery/bankruptcy departments. His representation of firm clients includes the prosecution and defense of claims for breach of contract involving businesses in the energy, health care and technology sectors. Mr. Isola represents organizations in Chapter 7 and 11 bankruptcy cases, including the resolution of adversary proceedings. In California state court, Mr. Isola frequently litigates applications for writs of attachment involving money owed under commercial loan, purchase and sale, and license agreements. He also has resolved actions filed for the benefit of creditors under California Code of Civil Procedure section 1800(B). Mr. Isola appears regularly in state and federal courts and has argued matters before the California Court of Appeal, First District.
Representative Cases
Prosecuted and tried action against former employee of workers compensation insurance carrier for breach of fiduciary duty, breach of contract and negligence in San Mateo County Superior Court.
Defended and resolved Trustee’s claim for accounts receivable and prosecuted medical association’s claims against Debtor’s bankruptcy estate in Specialty Physician Alliance Chapter 7 (Santa Rosa).
Defeated applications for writ of attachment, defended claims for breach of contract, and prosecuted action for recovery on letter of credit in dispute over purchase and delivery of natural gas (San Mateo County Superior Court, Pickens Fuel Corporation v. Texas-Ohio Energy Company).
Defended claims for breach of contract involving action on guaranty for commercial loan issued to medium-sized business by Fleet Bank (formerly Banc of Boston) in Santa Rosa Superior Court.
Defended and resolved preference actions filed in some of the larger Chapter 7 and 11 cases commenced in Bay Area Bankruptcy Courts, including but not limited to: In re Crown Vantage, Inc. and Crown Paper, Inc.; In re Stormedia Inc. et al.; In re Netpulse Media Networks, Inc.; and In re Napa Valley Physicians.
Prior Experience
As an attorney practicing in San Francisco since 1989, Mr. Isola has represented individual and corporate clients in a wide range of matters, including but not limited to patent infringement, negligence, fraud, breach of contract, civil harassment, conversion, defamation and unfair business practices. He has resolved cases through mediation, arbitration and trial. Prior to joining Davis Wright Tremaine, Mr. Isola was a partner with the San Francisco firm of Long & Levit LLP.
