Representative Experience
Representation of Wall Street broker-dealers, medical practice groups, defense contractors, advertising agencies, grocery chains, art wholesalers, music licensing agencies and individual officers and directors of financial institutions in a variety of complex business litigation matters, including the defense of state and federal securities fraud class actions, breach of contract and fraud actions, trade secret litigation, and suits alleging violations of California’s unfair business practices and unfair competition laws. Examples include:

• Co-counsel representing class of 27,000 songwriters and music publishers in federal class action alleging contributory and vicarious copyright infringement against Internet file-sharing services.

• Defended Wall Street broker-dealer in state court bondholder class action arising from the Orange County bankruptcy.

• Defended individual officers and directors of savings and loan in direct and class action litigation by shareholders, and claims by Resolution Trust Corporation, arising from largest S&L failure at that time.

• Defended cable television network and individual employees in three-week jury trial of breach of contract and unfair competition claims involving the creation of a television program.

• Defended litigation alleging theft of trade secrets, breach of fiduciary duty, and other business tort claims arising out of physicians’ establishment of competing medical practice group.

• Defended against antitrust and unfair competition counterclaims in action for copyright infringement by music publishing agency against record company.

• Defended regional grocery chain in two-week federal jury trial of breach of contract and alter ego claims. Defended art wholesaler in two-day AAA arbitration of breach of contract claims involving sales of vintage animation cells.

• Represented weekly newspapers in lawsuit based on competitor’s misappropriation of trade secrets concerning newspaper distribution.

Regular representation of newspapers, magazines, television networks and production companies, music publishers, motion picture studios and other businesses in litigation involving claims for defamation, invasion of privacy, misappropriation of ideas for movies and television programs, violation of the right of publicity, and copyright and trademark infringement.
