Federal regulation of the electric power industry, emphasizing FERC regulation of independent power producers, power marketers and other public utilities; licensing of hydroelectric projects; and regulation of public utility holding company systems.
Representative Experience
Regulation of independent power projects, power marketers and other public utilities under the Federal Power Act, including FERC proceedings to authorize market-based rate schedules, issuance of securities, mergers and acquisitions, transfer of jurisdictional facilities, interconnection and transmission service issues.
Regulation of qualifying facilities under the Public Utility Regulatory Policies Act, including FERC proceedings to certify cogeneration and small power production facilities, issuance of waivers, acceptance of rate schedules and restructuring of power sales contracts.
Licensing and regulation of hydroelectric projects under the Federal Power Act and related laws, including the National Environmental Policy Act, Clean Water Act and Endangered Species Act. Cases include City of Centralia, Washington v. FERC, 213 F.3d 742 (D.C. Cir. 2000).
Regulation of holding company systems under the Public Utility Holding Company Act of 1935, including approval of mergers and acquisitions, exemptions for wholesale generators and foreign utility companies, and regulation of holding company systems under the Public Utility Holding Company Act of 2005.
