Successfully defended Japanese corporation in binding arbitration against an action for breach of contract regarding a license agreement for e-timing services.
Represent major airline seeking business interruption losses from insurer resulting from the events of 9/11.
Procured summary judgment for private equity fund for damages arising from the breach of loan and guarantee agreements.
Represent an independent power producer in binding arbitration against California public utility regarding breach of terms of power purchase agreement.
Represent technology company in suit against former employees for copyright, trademark and trade dress infringements, business interference and unfair competition.
Represent beneficiaries of trust in action against trustees for the largest oil pollution event at the Guadalupe Oil Field and for divestiture of trust assets.
Represent commercial tenants in premises liability cases and environmental matters.
Successfully defended auto manufacturer in products liability suit.
Energy (transactional and regulatory):
Serve as regulatory counsel to independent power projects, investment banks and private equity clients regarding California energy regulatory issues in public and private debt and equity financings.
Represent clients in divestitures of major corporate assets.
Advise a small cap equity fund on regulatory issues related to the Public Utilities Holding Company Act.
Counsel clients on the application of energy regulations and public utility law to the development of electric generation facilities in California.
Negotiate interconnection agreements and other project agreements with public utilities on behalf of independent power projects.
Advise project developers and lenders regarding California Environmental Quality Act requirements and eminent domain issues in regulatory proceedings.
Represent clients in energy matters before the California Public Utilities Commission and the Federal Energy Regulatory Commission, including utility rate proceedings.
