Boris Gaviria


Boris Gaviria is a labor and employment attorney with an emphasis on litigation. He regularly defends employers against claims of race, gender, and other forms of discrimination, including sexual harassment, and litigates wrongful discharge and class action cases as well as general commercial litigation. Boris is fluent in Spanish and active in civic organizations.

Wielang v. Kadlec Regional Medical Center

Won a motion to dismiss all claims in a single plaintiff case involving allegations of disability discrimination and retaliation in state court. (Benton Cnty. Sup. Crt., October 2014)

Long v Kadlec Regional Medical Center

Won summary judgment in a single plaintiff case involving allegations of wrongful termination and retaliation in state court. (Benton Cnty. Sup. Crt., May 2014)

Providence v. Diederich

Won summary judgment on all state and federal claims alleging disability and age discrimination, hostile work environment and retaliation brought by a former physician resident in a family medicine program in a large teaching hospital in Olympia; also obtained order limiting breach of contract damages. (W.D. Wash., 2012)

French v. Providence Regional Medical Center Everett

Obtained a full defense verdict for our client after a weeklong jury trial in federal court. The case involved allegations of violations of the ADA, WLAD, FMLA, and public policy. (W.D. Wash., 2009)

General Employment Litigation

Moses v. Chelton Avionics

Defense verdict on substantially all claims after JAMS Arbitration. A former employee claimed in excess of $4.8mm in past due commissions on avionics component sales. (June 2014)

Subpoena counseling

Provide ongoing advice and counseling to airline client concerning responses to subpoenas from third parties, and government agencies. (Ongoing)

Meisner v. Doyon Construction

Summary judgment in favor of employer on claims of race discrimination, whistleblower retaliation, and defamation. (Pierce Cnty. Sup. Crt., 2013)

Green v. Seattle Art Museum

Represented the Seattle Art Museum in a race and national origin case brought by a terminated employee. The federal court granted summary judgment in all respects. On appeal, the 9th Circuit affirmed the dismissal. (W.D. Wash, 2009)

Nunnally v. XO Communications

Represented defendant in a whistleblower retaliation case in which plaintiff alleged wrongful, constructive discharge in violation of public policy. Motion for summary judgment was granted and case against our client was dismissed. (W.D. Wash., 2009)

Wage and hour class action dispute for residential drywall contractor

Defended residential drywall contractor in wage and hour class action litigation involving alleged underpayment of wages and overtime. Case settled after discovery, motion practice and court-ordered mediation. (2008)

Wage and hour class action dispute for national retailer

Defended an employer in the largest wage and hour class action in Washington history.
