Brad Guyton counsels clients on numerous aspects of communications law and related areas, focusing on Universal Service Fund (USF) contribution compliance, pole attachments and infrastructure deployment, accessibility, international regulatory compliance, and privacy and data security. Brad has a background in the analysis of communications-related case law and FCC decisions.

Representative Experience
USF Contribution Compliance
Analyzes client revenues and allocates relevant telecommunications, Interconnected Voice over Internet Protocol (VoIP), and other revenues to appropriate reporting lines for Form 499 reporting and customer billing purposes.

Advises clients undergoing Form 499 contribution audits.

Produces and files annual and quarterly Form 499 reports.

Works with analysts at USAC, the universal service program administrator, to assist clients with Form 499 contribution and payment issues, Filer ID deactivations, and other related USF contribution compliance processes.

Assists clients with producing "traffic studies" and associated documentation to accompany Form 499 filings, as required by the FCC in instances where filers estimate interstate revenues for certain Form 499 categories.

State USF Compliance
Counsels clients on funding application process and other regulatory obligations related to state USF funds, including OUSF (Oklahoma).

Pole Attachments and Infrastructure Deployment
Advises clients and negotiates pole attachment and franchise agreements to enable the deployment of wired and wireless (including microcell) pole attachments on utility- and municipally-owned facilities.

Counsels clients on pole-attachment related disputes, including dispute resolution negotiations and FCC or state regulator complaint proceedings.

Analyzes local zoning maps and ordinances for purposes of wireless tower siting due diligence.

Accessibility
Assists clients in implementing new accessibility rules stemming from the Twenty-First Century Communications and Video Accessibility Act of 2010 (CVAA).

Advocates for clients before the FCC via written comments in accessibility rulemakings.

Regularly authors client advisories explaining new FCC accessibility rules and compliance deadlines.

International Regulatory Compliance
Coordinates with local counsel in jurisdictions around the world to analyze local regulatory compliance requirements regarding telecommunications and value-added services licensing, infrastructure deployment, wireless internet services, and other proposed services.

Privacy and Data Security
Advises clients regarding privacy and data security requirements, primarily in international jurisdictions such as the UK and European Commission member states.

Special Access
Assisted several clients with FCC mandatory Special Access Data Collection response, including analyzing data, crafting written responses, and navigating the FCC’s Special Access Web Portal for submission of specially formatted data containers and essay responses.

Cable
Advocates for clients via written comments in policy rulemakings such as the FCC’s 2016 set-top box proceeding.
