Candice Tewell’s practice focuses on complex commercial litigation including class action, trade secret, and banking litigation. She also assists businesses and individuals facing criminal and civil government enforcement proceedings and investigations. Candice has experience arguing in the U.S. Court of Appeals and has co-tried felony jury trials to verdict as a Trial Fellow with the King County Prosecutor’s Office.

Representing criminal defendant on appeal in Washington constitutional challenge to imposition of cash-only bail. (Ongoing)

ChemPoint.com Inc. v. Xenon Arc, Inc. et al.

Represented e-distributor of specialty and fine chemicals in extensive state and federal trade secret litigation involving former corporate executives. Obtained favorable global settlement. (King Cnty. (Wash.) Super. Ct.; W.D. Wash. 2013)

United States ex rel. Prescott Lovern v. Prudential Ins. Co. of America, et al.

Defended insurance company in False Claims Act qui tam suit resulting in dismissal of all claims. (D.D.C. 2013)

Gilroy v. Seabourn Cruise Line Limited

Represented Seabourn Cruise Line in putative class action litigation arising out of announcement of skipped port calls as a result of “Arab Spring” disturbances. Obtained order compelling individual arbitration as required by Cruise Contract. 2012 WL 1202343 (W.D. Wash. 2012)

Arellano v. National wireless carrier

Represented national wireless carrier in litigation arising from 4G marketing campaigns. Obtained favorable ruling compelling arbitration as required by consumer contract. (N.D. Cal. 2011)

Boitano v. Bank of Washington

Defended Bank of Washington against lender liability claims brought by real estate developer. Obtained dismissal of claims on summary judgment. (King Cnty. (Wash.) Super. Ct. 2011)

Washington Federal v. Greenbriar Northwest Associates, LLC et al.

Represented bank in five related lawsuits involving approximately $25 million in commercial loans acquired from the FDIC resulting in favorable global settlement. (Whatcom Cnty. (Wash.) Super. Ct. 2011)
