Christin McMeley, CIPP/US, is the chair of DWT’s privacy and security practice. Christin advises companies in various industries in privacy compliance, information governance, data security, public policy, and regulatory matters. Christin advocates on behalf of clients before governmental agencies, legislative members and staff, represents telecom, cable, and wireless providers in regulatory proceedings before the FCC, and counsels clients on regulatory policy and compliance.

As a former Vice President, Chief Privacy Officer, and Deputy General Counsel to Charter Communications, she successfully implemented the company’s first privacy and data security program. Christin has extensive knowledge of privacy and security regulations, as well as hands-on experience with all aspects of privacy and information governance programs, including program development and management, employee training, compliance and risk assessments, and incident response. She is also a member of DWT’s Breach Response Team (dwt.com/IncidentResponse).

Within the communications industry, Christin has advised clients on key regulatory issues, including network neutrality, bandwidth management, broadcast signal carriage and other programming matters, and governmental lobbying.

Representative Experience

General privacy and information security counseling

Counseling clients’ compliance with general privacy and security laws, including the Communications Act, the Video Privacy Protection Act (the VPPA), the Children’s Online Privacy Protection Act (COPPA), the FTC Act, the Fair Credit Reporting Act (FCRA), the California Online Privacy Protection Act (CalOPPA) and the Massachusetts’ data security standards, among others. Incident response

Assisting clients with responding to privacy and information security incidents, including preparing incident response plans, communication plans, and notifications to consumer, governmental entities, and consumer reporting agencies. (Ongoing)

Online advertising counseling

Counseling clients on privacy and information security risks associated with online advertising, including online behavioral advertising and compliance with self-regulatory programs such as the Digital Advertising Alliance’s Self-Regulatory Principles for Online Behavioral Advertising and the Network Advertising Initiative’s Code of Conduct. Privacy and information security program compliance and auditing

Preparing privacy and security audit plans for clients; assisting clients in assessing privacy programs and subsequent remediation activities. (Ongoing)

Privacy and information security program development & training

Assisting clients with preparing and conducting privacy and security assessments, comprehensive privacy and security program development. Developing privacy and security training programs for clients in various industries. Assisting clients with the development and monitoring of records management programs. Preparing privacy information security policies and related procedures. (Ongoing)

Spokeo, Inc. v. Thomas Robins

Submitted amicus brief on behalf of a group of eight media amici urging the U.S. Supreme Court to overturn the 9th Circuit's ruling allowing a class action alleging violations of the Fair Credit Reporting Act to go forward without any allegation of an "injury in fact" for standing under Article III of the U.S. Constitution, and highlighting the damage to media companies caused by class actions where plaintiffs leverage technical violations of privacy statutes to threaten enormous statutory damages, severely impacting those companies' business models, and chilling speech. (U.S. 2015)

Provided legal support to Charter’s government relations teams, advising of legal and business implications of regulatory proceedings and pending legislation. (2011-2012)
