JA Investments LLC 2008 Represented owner of a shopping center sued for alleged violations of CC&Rs. Settled favorable to client; related title insurance claim pending. MBK Partnership 2008 Obtained settlement in recovery of insurance proceeds in a state, and federal superfund environmental claim. Cattle ranchers 2007 Defended Endangered Species and National Forest Management Act claims challenging a cattle grazing permit on Fremont-Winema National Forests; plaintiff's case was dismissed. MBK Partnership 2006 Response to claims of asbestos in homeowners' soil. Successfully litigated to obtain insurance coverage and indemnity. MBK Partnership 2006 Representation of the defendants against claims involving alleged asbestos contamination of a housing development and related enforcement action brought by the EPA and related insurance coverage claims against multiple carriers. Land owner 2006 Represented land owner sued for breach of contract; case dismissed. Warren C. Laird 2006 Livestock trespass claim by BLM resolved as inadvertant trespass. Dumas 2005 Successfully represented property owner in federal quiet title action to defeat U.S. government's challenge to title. Mendieta 2005 Representation in trial and appellate courts of plaintiff representing a class of approximately 150 cattle ranchers over uses relating to grazing leases on state lands. Resolved in Oregon Supreme Court with a favorable result and settlement. Oliver Spires dba Rivers End Ranch 2002 Defended suits by five Native American tribes involving federal and state government pursuant to the Native American Graves Protection and Repatriation Act and the Clean Water Act. Settlement achieved resolving all issues. Eastern Oregon Public Land Coalition 1999 Represented intervenor-defendant in case of first impression under §401 of Federal Clean Water Act. Represented client-intervenor on appeal to 9th Circuit Court of Appeals and successfully defended against Petition for Certiorari in U.S. Supreme Court. Weston 1999 Represented defendant in trial and on appeal in cost recovery and state Superfund and common law claims. Rich Franklin Corp. Represented client in environmental cleanup contract and cost recovery claim against a transportation company related to a capsized petroleum truck. Cleanup cost recovered against owner/operator of truck. S.P. Cramer & Associates Defended a fisheries consultant in an Endangered Species Act and Clean Water Act claim and related insurance coverage.
