David Maas

David Maas concentrates his practice on antitrust, class action, and complex commercial litigation. He represents plaintiffs and defendants across a broad spectrum of industries, including health care, technology, financial services, energy and natural resources, pharmaceuticals, manufacturing, and retail. David has handled cases or government investigations involving antitrust law, tax, securities laws, product liability, and the False Claims Act, along with consumer class action matters.

David also provides antitrust counseling to clients in connection with mergers, acquisitions, and affiliations. David has assisted clients in various industries, including health care and technology, with investigations by federal and state antitrust enforcement authorities.

Representing home health care provider in antitrust case alleging exclusive dealing with respect to sleep apnea products. (M.D. Fla. Ongoing)

Boehm et al. v. Getty Images (US), Inc. et al.

Representing the world's leading provider of stock photography in copyright infringement lawsuit and arbitration with two contributing photographers regarding Getty Images' licensing of their images. (W.D. Wisc. & AAA Ongoing)

Alcaras v. Hatteras Yachts*

Represented manufacturer of yachts in breach of contract case arising from sale of a multimillion dollar yacht. Obtained summary judgment on all of plaintiffs’ claims. (2015)

Blaum v. Triad Isotopes, Inc., et al.*

Represented supplier of radiopharmaceuticals in antitrust and qui tam False Claims Act case brought by competitor related to alleged bid-rigging in procurement of contract for provision of radiopharmaceuticals to county hospital system. Obtained dismissal of all antitrust and state law tortious interference claims. (2015)

Cox v. Sherman Capital*

Represented group of asset holding companies in putative class action asserting claims under the Racketeer Influenced and Corrupt Practices Act, along with numerous other state and federal claims. Defeated class certification. (2015)

Med. Mutual v. Eli Lilly*

Represented pharmaceutical company in putative class action alleging violations of the Racketeer Influenced and Corrupt Organizations Act and various statue consumer fraud statutes related to manufacture and sale of testosterone replacement therapy drugs. Court dismissed plaintiffs’ RICO claims. (2015)

Structured settlement industry cases*

Represented JGWPT Holdings, Inc. in putative class action asserting claims under the Racketeer Influenced and Corrupt Organizations Act relating to acquisition of rights to future income streams. Successfully obtained transfer of case to Northern District of Illinois and obtained reversal from 7th Circuit of order remanding case to Southern Illinois state court. (2015)

Maxwell v. First Analysis Corporation*

Represented largest minority shareholder in a private corporation in a breach of contract and shareholder oppression case against the company and its controlling majority shareholder. Case settled after successful summary judgment motion and bench trial on remaining claims. (2014)

Pro bono Fair Housing dispute for tenant with disabilities*

Represented tenant with disabilities pro bono in Fair Housing and discrimination dispute related to procurement of modifications to common elements and exceptions to association’s rules and regulations. Negotiated favorable resolution for client. (2014)

Zahran v. Bank of America, et al.*

Successfully compelled arbitration of all claims against national credit card issuer, including counts under Fair Credit Reporting Act. (2014)

Commercial arbitration*

Represented bank and affiliated brokerage in parallel AAA and FINRA arbitrations brought by borrower on large credit facility collateralized by operating units that were converted into shares in a public REIT when the value of the units dropped below the minimum required by the loan covenants. Successfully resolved both actions after piercing the borrower’s asserted privileges with respect to communications with his counsel and accountant regarding the credit facility. (2013)

Pirard v. Mortgage Electronic Registration Services, et al.*

Obtained dismissal with prejudice of antitrust claims against Mortgage Electronic Registration Service and numerous MERS member banks. (2013)

Smith v. AmeriGas Propane, L.P.*

Represented AmeriGas in wrongful death case arising from fire that occurred when decedent got into car accident with propane tanks in a vehicle. Obtained highly favorable settlement before summary judgment. (2013)

Unclaimed property audit and lawsuit*

Represented Fortune 500 company in lawsuit against the state of Delaware challenging the legality of administrative action in connection with state’s concurrent audit of company for compliance with escheat laws. Case was successfully resolved. (2013)

Fray v. LVNV*

Represented consumer debt asset holding company in putative class action under the Fair Debt Collection Practices Act and state consumer protection statute. Obtained dismissal with prejudice of all claims. (2012)
