John Goldmark focuses his practice on complex commercial litigation, with an emphasis on class action defense and intellectual property litigation. He has hands-on experience in a wide variety of matters, including consumer class actions, state and federal securities fraud claims, contract disputes, appellate litigation, and intellectual property disputes. John represents clients from a variety of industries, including telecommunications, international import, national retail, health care, and financial services.

Dennings v. Clearwire

Represent national wireless carrier in putative nationwide and six-state class actions in federal court alleging carrier breached its contracts and violated consumer protection statutes by advertising engaging in network management practices. (W.D. Wash. Ongoing)

Newton v. Clearwire

Represent national wireless carrier in putative nationwide class action in federal court alleging carrier breached its contracts and violated California’s consumer protection statutes by engaging in network management practices. (E.D. Cal. Ongoing)

Tavenner v. The Talon Group

Represent mortgage escrow company in putative class action in federal court alleging company charged fees for closing home loan in violation of the Washington Consumer Protection Act and other state law. (W. D. Wash. Ongoing)

Washington Mutual securities litigation

Represent former Washington Mutual officers in putative class action in federal court alleging securities fraud claims arising from collapse of housing market. (W.D. Wash. Ongoing)

FutureSelect v. Ernst & Young

Represent auditor in securities fraud suit in state court against negligent misrepresentation and state securities fraud claims arising from fallout of the Bernie Madoff Ponzi scheme. Obtained dismissal of all claims with prejudice. Plaintiffs’ appeal pending before the Washington Court of Appeals. (2012)

Schumacher v. Amazon

Represent online retailer in putative class action in California federal district court against product liability and warranty claims. Obtained dismissal. (2012)

W.S. Store Corporation v. Philip Morris

Represent international tobacco retailer and distributor against defamation claims in Washington state court. Obtained summary judgment dismissal with prejudice. (2012)

EdiZONE v. Toysmith

Lead counsel to major toy wholesaler in defense of patent infringement suit involving color-changing toys. Obtained voluntary dismissal with prejudice of all claims. (D. Utah 2011)

FutureSelect v. Ernst & Young

Play Vision v. Dollar Tree Stores

Represent national retailer of patent, copyright, and trademark infringement suit involving various thermoplastic rubber toys. Obtained voluntary dismissal with prejudice of all claims, including court ordered monetary sanctions and attorneys’ fees against plaintiff and its counsel. 2011 WL 2292326 (W.D. Wash. 2011)

Carroll v. Lee

Pro bono representation of individual alleging civil rights violations for detention beyond statutory maximum sentence. Obtained favorable settlement on plaintiff's behalf. (W.D. Wash. 2010)

Todd v. City of Auburn, et al.

Represented nation’s largest vendor of automated red-light traffic cameras in Washington state class action alleging violations of the Washington Consumer Protection Act and state statute governing cameras. The court granted defendants’ motion to dismiss. The case was affirmed by the 9th Circuit Court of Appeals. 2010 WL 774135 (W.D. Wash., 2010), aff’d 425 Fed. Appx. 613 (2011)
