Lauren Rainwater focuses her practice on complex commercial, business, and intellectual property litigation. She represents clients in federal and state court proceedings across a wide range of industries, including banking and finance, insurance, telecommunications, and construction. Lauren counsels on contract disputes, consumer fraud and deceptive practice act claims, insurance bad faith claims, class actions, product liability claims, and other business torts. She also advises on cases involving allegations of design patent infringement, trade dress infringement, and trademark infringement and dilution.

Lauren has also represented clients in trusts and estates matters involving will contests, lost wills, and disputes over trust accountings; trustees and successor trustees in defending claims for breaches of fiduciary duties and failure to account; successor trustees in prosecuting claims for breaches of fiduciary duty and imprudent investments; and personal representatives and heirs in probate litigation, including defending against the removal of personal representatives.

Soto v. Microsoft Corp.

Defending online services provider in lawsuit brought by two employees alleging provider’s efforts to create unique wellness programs and technologies designed to assist employees whose jobs involved content review did not meet the standard of care. (King Cnty. (Wash.) Super. Ct. Ongoing)

Municipality of Anchorage v. Integrated Concepts and Research Corporation, et al.

Defended PND Engineers Inc. against negligent design claims brought by the Municipality of Anchorage over a large port improvement project, seeking over $100 million in damages from PND. Successfully settled the lawsuit for less than $1 million. (D. Alaska 2013-2017)

Microban Systems, Inc. v. Skagit Northwest Holdings, Inc.

Represented subsidiaries of Microban International Inc. in suit against licensee for breach of license agreement for MICROBAN trademark and trademark infringement for use outside scope of license. Successfully settled after cross-motions for summary judgment. (W.D. Wash. 2015-2016)

Rosenkranz v. U-Haul Co. of Washington

Defended U-Haul Co. of Washington against claim that U-Haul negligently maintained certain equipment, which caused an injury to the plaintiff. Second chaired the trial and obtained a complete defense judgment at trial. (Clark Cnty. (Wash.) Super. Ct. 2013-2016)

Acme v. CCI, Inc.

Representing CCI, Inc. in defending against claims of breach of contract and fraud brought by subcontractor in construction of the Port of Umm Qasr, Iraq.  Successfully obtained summary judgment dismissal of Acme's claims against CCI, Inc. (D.D.C. 2013-2015) 

SBI Holdings Inc. et al. v. Acucela Inc.

Successfully represented ousted company founder and CEO, as well as largest shareholders, in lawsuit demanding that the company hold a special shareholder meeting.  After the court compelled a special shareholder meeting, a new slate of directors was elected and the founder was promptly restored to his position as CEO. (Thurston Cnty. (Wash.) Super. Ct. 2015)

Huysing v. Northwestern Mutual Life Insurance Company*

Represented Northwestern Mutual in an action for breach of contract and bad faith brought by the owner of a disability insurance policy. Reached a successful resolution. (2014)

Ritchie Bros. v. Best Rental, et al.*

Represented Ritchie Bros. in bringing claims for breach of contract and tortious interference with contract against competitor and consignor. Obtained favorable settlement. (2014)

FDIC as Receiver for Westsound Bank v. Johnson, et al.*

This case was brought by the FDIC, as the receiver for Westsound Bank, against various former officers and directors. Represented former vice president of the bank, and moved to dismiss the claims filed against him. Obtained a settlement on favorable terms while the motion to dismiss was pending. (2013)
