Marc G. Fernandez


Marc Fernandez counsels employers on complex personnel issues involving wage and hour disputes, leaves of absence, privacy, terminations, and workforce reductions. In his litigation practice, Marc helps clients protect trade secrets and defend against single-plaintiff and class action lawsuits involving wrongful termination, and wage and hour issues. He represents clients under investigation by the Equal Employment Opportunity Commission and the Department of Fair Employment and Housing for alleged discrimination, harassment and retaliation.

Marc also drafts and revises employment policies and manuals. His clients range from start-ups to Fortune 500 companies, including Kaiser Permanente, Shape Security, AJ Tutoring LLC, and others.

Successfully obtained restraining order against individual on behalf of local broadcast news talent. (2013)

Del Norte Triplicate v. Maietta

Successfully obtained restraining order against individual threatening staff of local newspaper. (2012)

Prisco v. DNC Parks & Resorts

Successfully argued demurrer to complaint, resulting in full dismissal with prejudice based on federal enclave jurisdiction in unlawful eviction and wrongful termination lawsuit for a national parks concessioner. (2012)

Wrongful termination mediation and settlement for various clients

Obtained favorable settlements in mediation of wrongful termination lawsuits for clients in health care, telecommunications and hospitality industries. (2012)
