Marco de Sa e Silva chairs the firm's real estate and land use practice group and represents clients in real estate transactions and land development projects. His work includes commercial real estate purchases and sales, subdivisions, aquatic projects, wind energy projects, surface mines, timberland transactions, SEPA environmental review, land use code interpretations and zoning letters, development agreements, condominium creation, and mixed-use projects. He helps clients resolve ownership and use issues and create easements, restrictive covenants, ground leases, and licenses. Marco’s land use planning background includes frequent representation before government agencies and extensive work in acquisition due diligence and permitting. He has represented clients in land use hearings before more than 50 different administrative agencies and courts throughout Washington.

Represented charitable organization in purchase and lease back of more than 800 acres of Camp Korey facilities and agricultural land in King County, Washington.

Represented seller of 210-acre residential development site in Bremerton, Washington.

Represented timberland investment fund in purchase from Forest Capital of 5,297-acre tree farms in Tillamook and Yamhill Counties, Oregon.

Represented timberland investment fund in purchase from Green Diamond of 6,378-acre Rockaway tree farm in Tillamook County, Oregon.

Represented seller of industrial development parcels in Bremerton, Washington.

Wind Energy Projects

Represented wind energy project owner in land use due diligence for $125 million project financing of a wind project in Walla Walla County, Washington.

Represented lender as local counsel in $635 million financing of wind energy project in Klickitat County, Washington.

Represented wind energy project owner in analysis of title and survey issues and creation of amendments to wind energy lease and access, transmission, and substation easement agreements for $220 million wind energy project in Klickitat County, Washington.

Commercial and Residential Subdivisions

Represent property owners and developers in obtaining preliminary plat approval and creating final plats, declarations of restrictive covenants, declarations of easements, public offering statements, and forms of purchase and sale agreements, for the creation and sale of commercial and residential building lots.

Create owner associations and amend owner association governing documents.

Land Use Planning and Development

Represented owner and developer of Port Ludlow Master Planned Resort, a mixed use project in Jefferson County, Washington, in multiple land use proceedings for commercial and residential projects, including residential subdivisions, marina expansion, attached housing, and mixed use development.

Represented developer of Mercer Island retail project in six successful contested hearings, including design review approval, environmental review approval, court approval following appeal under Land Use Petition Act, and city council approval of development agreement.

Represented owner and developer of 225-unit multi-family and mixed-use building on Aurora Avenue in the Queen Anne neighborhood of Seattle in land acquisition, design review, master use permit, street vacation and project sale.

Represented shopping center owner in successful opposition to proposed Kirkland comprehensive plan and zoning code amendments.

Represented other clients in land use hearings before more than 50 different administrative agencies and courts throughout Washington.

Negotiated development agreements and amendments with the Cities of Bremerton, Mercer Island, and Gig Harbor, and Jefferson County, on behalf of various project developers.
