Max Hensley

Max Hensley has experience with trial and appellate litigation in the civil, criminal, and administrative contexts. He has worked as a law clerk for Judge Ronald Gould on the U.S. Court of Appeals, 9th Circuit, as an intern for the California Attorney General’s office and the U.S. Attorney’s Office for the Eastern District of Michigan, and represented clients as a member of Michigan Law’s General Clinic. Max was an aide in the Alaska State Senate prior to attending law school.

Representative Experience

Defense of whistleblower claims

Obtained a complete defense verdict after a seven-day jury trial on claims made by a company’s former chief legal officer alleging retaliation in violation of the whistleblower protection provisions of the Sarbanes-Oxley and Dodd-Frank Acts. (W.D. Wash. 2017, 9th Cir. Ongoing)

Lopez-Gomez v. Holder

On appeal, achieved reversal of summary judgment and remand for trial on citizenship claims in pro bono representation of immigration defendant. (9th Cir. 2017)

VHT Studios Inc. v. Zillow Group Inc. et al.

Representing VHT in a copyright infringement suit for the unauthorized copying of thousands of photographic images owned by VHT on Zillow’s Digs home-design website and on properties not actively listed for sale on Zillow’s central listing website. Obtained favorable jury verdict after seven-day trial. (W.D. Wash. 2017, 9th Circ. Ongoing)

Accounting fraud investigation

Represented public company and its executives under investigation by the U.S. Securities and Exchange Commission for alleged accounting fraud and whistleblower retaliation. Achieved favorable corporate settlement. (2016)

Geier v. m-Qube, Inc.

Defended putative consumer class action in Western District of Washington and 9th Circuit Court of Appeals. Favorable settlement after denial of class certification. (W.D. Wash. and 9th Cir. 2016)

Insurance fraud investigation

Represented an executive under investigation by the U.S. Department of Justice for criminal government contracting and insurance fraud; no individual criminal or civil charges brought. (E.D. Va. 2016)

Microsoft Corp. v. Gulfcoast Software Solutions, Inc.

Represented Microsoft in copyright, trademark, and consumer protection enforcement action against distributor of counterfeit and illegally acquired software and software components, leveraging cutting-edge cyberforensic investigations and evidence. (W.D. Wash. 2016)

Cato Sales & Trading v. Cosmo Specialty Fibers, Inc.

Represented an entrepreneur in contract dispute against a private equity group in multiple related suits. (W.D. Wash. 2015)

Fraud investigation

Represented a public figure under investigation for criminal fraud by the U.S. Department of Justice. (W.D. Wash. 2015)
