Peter Isola is a veteran civil litigator with more than two decades of experience. He represents and advises businesses in the prosecution, defense, and resolution of claims in the energy, financial services, and telecommunications sectors. Peter represents banks and other creditors in many different areas, including construction, health care, hospitality, intellectual property, and real estate. He also has experience litigating trade secret cases, employment matters, and claims against officers and directors. Peter continues to maintain a diverse litigation practice focused on the resolution of disputes through negotiation, mediation, arbitration, motion practice, and trial.

Action against officers and directors of restaurant chain

Defending officers and directors of international hamburger franchise in action by Bankruptcy Trustee seeking recovery of alleged fraudulent and preferential transfers. (Ongoing)

Dispute involving wireless telecommunication sites

Defending major wireless service provider in action for breach of contract and other claims asserted by Bankruptcy Trustee arising from debtor contractor’s partial performance under master construction service agreement. (Ongoing)

Recovery of assets upon default of note and security agreement

Representing major credit company in dispute with borrower and guarantor in default of aircraft finance transaction. Multiple actions pending in two jurisdictions involving efforts to gain possession of aircraft and obtain monetary judgments for breach of loan and guaranty. (Ongoing)

GE Capital v. Alonzo Printing Co.

Represented lender in state court and ensuing bankruptcy case. Successfully recovered equipment purchased by borrower and obtained writ of attachment against real property owned by guarantor. Achieved monetary settlement through sale of real property in guarantor’s bankruptcy case. (2011)

Citibank v. Oxford Street Properties LLC

Prosecuted and tried action in Los Angeles Superior Court for recovery of third party claim against funds held by bank and escrow company. Action arose out of client lender’s financing purchase of high-rise development complex in downtown Los Angeles secured by first-priority deed of trust. (2010)

Zen-Noh Hay, Inc. v. Jabez AG, Inc

Prosecuted action for supplier of agricultural product and obtained breach of contract judgment of over for $400,000 against distributor. (San Mateo Cnty. (Cal.) Super. Ct. 2010)

Citibank v. Bajoria et al.

Prosecuted action for judicial foreclosure, obtained appointment of receiver, addressed environmental issues, and negotiated sale of note involving multi-unit apartment building in Stockton, Calif. (San Joaquin Cnty. (Cal.) Sper. Ct. 2009)

Shanghai Pudong Development Bank v. Textainer Limited

Successfully intervened in pending action on behalf of Chinese (Shanghai) bank and recovered more than $1 million on letter of credit involving international shipment of goods. (San Francisco Cnty. (Cal.) Super. Ct. 2006) 

Glassey v. Amano Corporation

Successfully defended against claims for breach of contract, misappropriation of trade secrets, and infringement of intellectual property rights involving e-timing technology system. Obtained complete defense and recovered over $400,000 in attorney’s fees in arbitration. (San Francisco Cnty. (Cal.) Super. Ct. 2005)

Insurance Commissioner for the State of Hawaii (Metcalf)

After collecting $1 million on Letter of Credit issued by West Pac Banking Corporation for benefit of the State of Hawaii Liquidation Office, prosecuted and tried action against former employee of liquidated workers compensation insurance company for breach of fiduciary duty, breach of contract and negligence. (San Mateo Cnty. (Cal.) Super. Ct. 2003)
