| Bob Scott is Co-Chair of the firm's Communications Department. He represents cable, telecommunications and Internet service providers in federal and state courts, as well as before the Federal Communications Commission (FCC), state legislatures, state public service commissions, and local governments. Bob has extensive litigation experience as lead counsel in cases that require an understanding of the laws, technologies, and competitive forces of the cable, telecommunications, Internet, and related businesses. Bob complements his litigation practice counseling clients on the laws governing communications networks (including the federal Communications Act), competition, and the use of public and private rights of way. Selected Experience National provider of broadband services Ongoing Counseled and represented major cable operator seeking municipal reimbursement for costs associated with the relocation of cable system as part of various municipal improvement projects. National cable service provider 2010 Represented national cable service provider before the Federal Communications Commission in proceedings concerning exclusive cable television service in condominiums, apartments and other multiple-dwelling buildings. These proceedings threatened the cable industry's large investment in wiring buildings in exchange for service rights. National provider of broadband services 2010 On behalf of a major cable television operator, won a motion to dismiss a federal complaint brought by a utility company that demanded higher pole attachment payments for the operator's provision of telecommunications and voice services over its cable system. National provider of broadband services 2009 Defended cable operator in a putative class action by the residents of an area of a county annexed by a city. The plaintiffs claimed cable operator should charge them lower cable television rates. Dismissed with prejudice by trial court as pre-empted by federal Cable Act. The dismissal was affirmed by the Washington State Court of Appeals. National provider of broadband services 2008 Represented national provider of cable television, Internet and telephone services defending claims of improper price competition in multi-forum litigation brought by competitor. National provider of broadband services 2008 Lead counsel defending national provider of cable services against claims brought by several cities challenging provider’s plan to change the channel location and format of public, governmental and educational access channels. National provider of broadband services 2008 Lead counsel for national provider of broadband services against claims of a city seeking payment of local franchise fees on revenue received by the cable provider from its provision of broadband Internet access service. National provider of broadband services 2008 Counsel for national cable television operator in a case challenging requirements under New Jersey law for cable operators to allow competitors to use their cable networks. Adams Cable 2008 Lead counsel for Adams Cable defending a complaint filed by TV station concerning carriage of the station on Adams’ cable systems.
