Representative Experience

Defended Cobalt Mortgage in multiple wage and hour class actions

Reached favorable settlements in three class actions after protracted litigation. Cases alleged off-the-clock work violations for mortgage loan officers and supporting employees. (2016)

Fenley v. Rite Aid Corp.*

Obtained dismissal of representative claims under the California Labor Code Private Attorneys General Act, alleging employer misclassified retail store managers. (Cal. Sup. Ct. 2015)

Gasio v. Target Corp.*

Defeated class certification in case alleging retailer required closing-shift employees to wait involuntarily and off-the-clock before leaving stores. (E.D. Cal. 2015)

Holak v. Kmart Corp.*

Defeated class certification in case alleging wage-statement violations and off-the-clock work, and obtained partial summary judgment on plaintiff’s individual claims. (C.D. Cal. 2014)

Rutti v. LoJack Corp.*

Defended employer in complex wage-and-hour class action raising novel commute-time and off-the-clock work claims. (C.D. Cal. 2011)

Muniz v. United Parcel Service, Inc.*

Second-chaired sex discrimination trial and obtained favorable jury verdict awarding plaintiff less than three percent of the damages she sought. (N.D. Cal. 2010)

United Parcel Service single-plaintiff exempt status litigation*

Defended employer in single-plaintiff exempt status cases filed after decertification of a class action. (Various California federal and state courts, 2008-2010)
