Wendell Kusnerus brings 30 years’ experience to his practice, including 17 years as in-house counsel for U.S. Bank. He represents financial institutions in all aspects of commercial lending, including complex loan transactions, negotiated amendments and workout agreements, and appears in state, federal and bankruptcy courts to protect and enforce lenders' rights. Wendell also represents banks in commercial disputes, such as those involving forged checks and other negotiable instrument problems.

Represented a financial institution in the Chapter 11 bankruptcy filed by this real estate entity. After obtaining appointment of a trustee, drafted and obtained confirmation of a creditor's liquidating plan of reorganization. (Ongoing)

Representation of financial institution in state court lawsuit and workout with grass seed farmer

Represented a financial institution with respect to delinquent obligations totaling eight-figures, owed by a grass seed farmer. Filed a foreclosure lawsuit in state court and obtained provisional process attaching the collateral. Negotiated a workout, which has resulted in full payment of the largest obligation; refinancing of the remaining obligations is pending. (Ongoing)

Represented a financial institution in the Chapter 11 bankruptcy filed by this entity, which owns a rock quarry. Prevented approval of the debtor's motion to sell the client's collateral, free and clear of liens, on very unfavorable terms; plan of reorganization, with substantially improved payment terms, is about to be confirmed.
