Zana Bugaighis concentrates her practice on complex civil litigation, with particular emphasis on consumer class action defense, financial services litigation, and non-compete enforcement. She represents clients from a variety of industries, with a specialty in online retail businesses such as Expedia, Hotwire, Amazon, and GNC.  Zana also has broad experience with consumer protection lawsuits, deceptive pricing litigation, and complex contract disputes, data breach security/privacy issues, and is an experienced trial attorney in federal and state court.  As a former law clerk, Zana additionally offers the firm’s clients legal experience in U.S. District Court.

Cousineau v. Microsoft

Represented Microsoft in putative nationwide class action litigation alleging violation of Electronic Communications Privacy Act and other statutes arising from collection of location information through Windows Phone mobile operating system. Won dismissal of most claims on motion to dismiss. After discovery, won summary judgment on remaining claim. (W.D. Wash. 2014)

Radonovich v. Amerititle, Inc.

Represented escrow service provider in putative class action alleging company misrepresented certain fees in violation of the Washington Consumer Protection Act and other claims. Resolved favorably through settlement. (Kittitas Cnty. (Wash.) Super. Ct. 2014)

Other Litigation

Coonan v. Inland Telephone Company

Represented related wireless and wireline telephone companies and their senior executives in contract and employee benefits dispute filed by former executive, focusing on dispute over value of executive’s shares in wireless company. Following extensive discovery and motion practice, the case settled satisfactorily. (Kittitas Cnty. (Wash.) Super. Ct. 2014)

Schmidt v. State of Alaska

Successfully established a property tax exemption violates the equal protection rights of same-sex domestic partners under Alaska law. Obtained summary judgment against state and municipality, which the Alaska Supreme Court affirmed on appeal. (2012)

Meyer v. National wireless carrier

Successfully compelled arbitration of a putative consumer class action. (2011)

The Laura Scudder's Company, LLC v. Snack Alliance, Inc. et al.

Represented Shearer's Foods, Inc and Snack Alliance, Inc. in a California trademark licensing dispute. Obtained settlement. (2011)
