Healthcare Industry Summit 2025

Adam Greene specializes in health information privacy and security laws, using his experience as a former regulator to help clients understand how they can permissibly leverage their health data, bring their information security programs into compliance with the HIPAA Security Rule, and respond to potential breach incidents. He works with healthcare providers, health plans, cloud services providers, health IT companies, and financial institutions to navigate HIPAA and the patchwork of other federal and state health information laws. His work ranges from applying health information laws to new technologies, such as AI and machine learning, to working with organizations to analyze complex privacy and security incidents involving health data under federal and state breach notification laws.

Before joining DWT, Adam worked on HIPAA and the HITECH Act at the U.S. Department of Health and Human Services in its Office of General Counsel and Office for Civil Rights. He drafted and negotiated the first HIPAA financial settlement agreements on behalf of the government, and assisted with implementing the HITECH Act and drafting the first HIPAA Breach Notification Rule. He also advised the Department on applying HIPAA to a variety of technologies, such as texting, cloud computing, and national health information exchange.

Adam has been ranked as one of the "Top 10 Influencers in Health InfoSec" and one of the "50 Top Healthcare IT Experts". He has provided hundreds of presentations, serves on a number of advisory boards, and is frequently quoted in the news on privacy and security matters. He helps his clients navigate the newest challenges through his leadership, credibility, and experience.

Privacy and security compliance policies

Works with clients to create comprehensive privacy and security policies that are operational and consistent with regulators' expectations. Works with clients to bring their policies and procedures to the next compliance level.

Digital bridge

Serves as outside counsel to central participants in the Digital Bridge project, a public-private initiative to automate information exchange between healthcare providers and public health agencies on a national level. Assists the project with applying privacy and security laws, as the program scales from a pilot to a national program.

Health information privacy counseling

Assisting a variety of healthcare providers and health plans on complex day-to-day health information privacy challenges, such as designating as an affiliated covered entity, hybrid entity, and organized healthcare arrangement under HIPAA, sharing information between the provider side and group health plan to improve care and reduce costs, providing access in response to both patient and third-party requests under HIPAA and state law, and structuring complex transactions involving de-identified information. Clients include some of the top healthcare systems in the country, small health providers, vision and dental plans, group health plans, and service providers of every size and type. (Ongoing)

Business associate compliance

Working with a range of business associates, including top cloud services providers, startup and midsize health information technology companies, and financial institutions on creating or refining privacy and security programs to comply with HIPAA and unique state law requirements, such as the Texas Medical Records Act and the California Confidentiality of Medical Information Act. (Ongoing)

Information security compliance

Working with covered entities' and business associates' information security staff to enhance their information security programs to comply with HIPAA's unique documentation requirements and the HHS Office for Civil Rights' (OCR's) particular expectations. (Ongoing)

Health-related apps

Assisting app developers with understanding if their app falls outside of HIPAA and to comply with other relevant laws, such as the FTC Act and the California Confidentiality of Medical Information Act. (Ongoing)

Breach response

Regularly assisting covered entities and business associates with applying the HIPAA Breach Notification Rule and other HIPAA and state reporting requirements to understand reporting requirements for privacy incidents, security incidents, and "breaches." (Ongoing)
