Adam Caldwell represents clients in complex commercial litigation and appeals in state and federal courts nationwide. Adam litigates a wide variety of matters, including consumer class actions; employment claims including sexual harassment and age discrimination; defamation and other privacy torts; piracy and intellectual property claims; complex contract disputes; and claims against local and state governments and regulators.

Adam focuses on the communications industry, and has represented cable, telecommunications and broadcast companies, as well as investment companies.

Representative Experience

Breach of contract regarding statutory royalties for national cable service provider

Representing client in prosecution of breach of contract claim to recover, statutory copyright royalty fees paid in relation to carriage of broadcast television station. Obtained summary judgment and now proceeding in bankruptcy court. (Ongoing)

Valentine v. Nebuad

Obtained dismissal on lack of jurisdiction, on behalf of internet service provider Bresnan Communications in federal privacy lawsuit challenging the use of deep-packet inspection technology (2009). Won dismissal of sister-case in Montana and currently on appeal in the 9th Circuit. (Ongoing)

Lopez et al. v. Council on American Islamic Relations (CAIR)

Successfully defended leading non-profit advocacy group against alleged RICO violations before US District Court for the District of Columbia and U.S. Court of Appeals for the D.C. Circuit. (D.C. Cir. 2010)

Donohoe v. Bonneville International Corp.

Defended Bonneville against age discrimination claim in relation to restructuring of broadcast radio stations. (2009)

Putative statewide privacy class action for national cable service provider

Represented national cable service provider in putative statewide class action alleging state wiretap claims in relation to call center operations. Obtained order enforcing clients arbitration provision including its ban on class action litigation. Affirmed on appeal. (2010)

Class action claim for national cable service provider

Prevailed before the Maryland Court of Appeals affirming the dismissal of a novel class action claim alleging statewide trespass in relation to client's placement of facilities. (2007)

In re National Security Agency Telecommunications Records Litigation

Obtained the dismissal of three electronic companies from a nationwide class action case accusing defendants of assisting the U.S. government in conducting warrantless wiretaps. (2007)

In re: Adelphia Communications Corporation

Litigated a variety of contract claims against Adelphia in what was at the time the largest domestic bankruptcy. (2006)

Wireless tower siting litigation for national wireless carrier

Represented national wireless carrier in numerous successful claims in federal courts against municipalities who had denied applications, to construct wireless facilities in violation of the Federal Communications Act and local zoning ordinances. (2005)

Syndicated Communications Venture Partners III v. Diamond Radio

Represented venture capital client in actions in Maryland and California courts in complex contracts case to enforce clients' rights as creditors, force the sale of a radio station, and obtain recovery of amounts due under certain stock and warrant rights. Obtained judgments enforcing clients' rights and allowing full recovery. (2004)
