Carol Noonan advises and defends employers in a broad range of employment and general litigation matters. She focuses on defending discrimination, retaliation, interference and harassment claims involving employee medical and health issues under federal and state laws relating to ill or injured workers, such as the Oregon Family Leave Act (OFLA), the Family and Medical Leave Act (FMLA), the Americans with Disabilities Act (ADA) and Oregon disability discrimination and workers’ compensation discrimination statutes. Her other litigation work includes representing employers in disputes involving other forms of employment discrimination, retaliation and harassment, wage and hour laws, and wrongful discharge in federal and state courts and before the Oregon Bureau of Labor and Industries (BOLI) and the Equal Employment Opportunity Commission (EEOC). Many of Carol’s litigation clients are employers in the health care and manufacturing industries.

Carol’s counseling practice covers advice on litigation avoidance, particularly with respect to managing ill or injured workers, as well as all types of employment matters, and includes training of both managers and staff. She also specializes in drafting and reviewing employment-related agreements and policies.

Representative Experience

Larmanger v. Kaiser Foundation Health Plan of the Northwest

Obtained summary judgment on seven claims that included leave discrimination, aiding and abetting discrimination, and whistleblower retaliation brought by patient care manager against major health care employer. (D. Or. 2012)

Teague v. Legacy Health

Motion for summary judgment granted on each of six claims for employment discrimination under the Oregon Family Leave Act, Oregon disability discrimination statutes, and breach of contract. (Multnomah Cnty. (Or.) Cir. Ct. 2011)

Hilde v. Pinnacle Healthcare, et. al.

Motion to dismiss with prejudice granted in favor of individual defendants, and summary judgment granted to remaining defendant on breach of an employment contract claim. (Lane Cnty. (Or.) Cir. Ct. 2011)

Nolan v. Transcend Services, Inc.
