Dipa N. Sudra


Dipa Sudra advises employers on all types of employee benefits and ERISA-related issues. She focuses on designing, drafting and implementing 401(k) and profit-sharing plans, pension plans, health and welfare benefit plans, wellness plans, fringe benefit plans and cafeteria plans.

As part of her counseling practice, Dipa helps employers restructure their benefits programs to address changes in laws such as the Affordable Care Act, COBRA, FMLA, HIPAA, and GINA. She also advises employers on current issues affecting benefit plans such as the impact of domestic partnerships and same-sex marriages and assists employers with employee communications materials and administration forms, preparing determination letter applications and qualified plan correction applications under EPCRS.

Drafts 401(k) and profit-sharing plans, amendments, and all associated documents, such as forms, procedures, administrative committee charters and summary plan descriptions; prepares determination letter applications; assists clients with the IRS voluntary correction program; and provides advice with respect to the ongoing administration of defined contribution plans, such as claims under the plan (Ongoing)

Health and welfare plans

Work extensively with health and welfare plan sponsors and assists them in drafting and amending health and welfare plans, retiree plans, cafeteria plans and wellness plans; prepares and reviews all associated documents, such as forms, procedures, summaries of benefits and coverage, annual notices and summary plan descriptions; advises on compliance issues arising from the Internal Revenue Code, ERISA, COBRA, and HIPAA, including health care reform related issues; assists with operational issues related to health and dependent care flexible spending accounts; drafts HRA and HSA plan documents and advises on appropriate structuring of such arrangements; advises on multiple employer welfare arrangements (Ongoing)
