Janet Grumer

Janet represents employers in a wide range of disputes before state and federal courts and agencies, including disputes involving claims of harassment, discrimination, and retaliation, wage and hour class actions, and administrative proceedings before the Employment Development Department, Division of Labor Standards Enforcement, Department of Fair Employment and Housing, and Equal Employment Opportunity Commission.

She also provides advice and counsel aimed at preventing litigation, including advice on sexual harassment prevention, investigations, terminations of employment, reductions in force, employee disciplinary actions, creating personnel policies, and drafting employee handbooks.

ADA Disputes
Janet represents businesses in Americans with Disabilities Act public accommodation disputes.  She also provides preventative advice and counsel, works with clients to develop effective ADA policies and practices, and coordinates with experts on remediation.

Defend high-profile class action case brought by disabled plaintiffs alleging violations of the Unruh Act and California Disabled Persons Act and seeking to compel to provide closed captioning on website videos. (Ongoing)

Pre-litigation settlement of employment claims

Favorably settled employee claims alleging unpaid wages, discrimination, harassment, retaliation, missed meal periods and wrongful termination before lawsuits were filed. (Ongoing)

Single-plaintiff employment defense litigation for Bank of America N.A., Bank of America Home Loans, Merrill Lynch, Kaiser Permanente, and Stewart Enterprises

Represent large organizations in defending single-plaintiff employment matters--before and after the filing of a lawsuit--in the areas of discrimination, wrongful termination, retaliation, wage and hour, and breach of contract. (Ongoing)

Stoddart v. Express Services Inc.

Lead defense counsel in California wage-and-hour class action brought by transportation and warehouse storage workers against temporary staffing agency. (Ongoing)

Gash v. Pensar Big, Inc., Johnson v. Turner Broadcasting, Carr v. Dancing with the Stars, Ramirez v. Warner Bros., and others

Lead defense counsel in cases alleging discrimination in public accommodations. (2008-2012)

Pre-litigation settlement for Alaska Airlines

Obtained quick, no-cost settlement against plaintiff who claimed missed meal breaks and overtime violations. Plaintiff withdrew all claims two months after demand letter. (2012)

Single-plaintiff litigation settlement for Ace Hotels

Favorably settled claims of discrimination, retaliation, harassment for owner-developer of lifestyle hotel properties. Also drafted employment and separation agreements for management-level staff. (2012)

Farmer v. Searles Valley Minerals Operations

Defense counsel in action alleging disability discrimination, failure to accommodate, and interference with alleged union-organizing. Obtained summary judgment on all claims. (2011)

Lucarini v. Dresser, Inc.

Defense counsel in wage and hour class action brought on behalf of oil industry technicians alleging violations of alternative work week, meal period, on-call time, and off-the-clock rules. (2010)

HR Advisors v. HR Now

Plaintiff's counsel in action alleging misappropriation of trade secrets and unfair business practices. Obtained preliminary injunction prohibiting unlawful solicitation of plaintiff's customers by its former executive-level employee. (2008)
