Represented start-up company Endo Vascular Instruments, Inc. (EVI) in a "bet the company" case. DWT joined the case at the last minute to prepare the matter for trial. By taking a very narrow approach to the case, DWT was able to prevail on summary judgment, thus extricating the client from a much larger series of cases, which defendants lost. Plaintiff appealed the judgment and we prevailed in the Court of Appeals.

Represented client in a suit against Greenwood Forest Products and two of its former owners and officers. Plaintiffs sought damages for breach of contract and reformation of notes given in connection with an asset purchase agreement consummated in 2002. Defendants counterclaimed for approximately $1 million in dispute. The case went to trial in May, 2006 and resulted in an inconsistent verdict awarding both parties damages on the breach of contract claim and counterclaims. The Defendants appealed and the Court of Appeals reversed the jury verdict in favor of Jewett-Cameron. Jewett-Cameron and Greenwood Products, Inc. appealed to the Oregon Supreme Court and it reversed the Court of Appeals, reinstating the judgment in favor of Jewett-Cameron.

Represented defendant on a claim of infringement of a registered trade dress involving a functionality defense. (D. Or.)

Represented plaintiff in a breach of trust and breach of fiduciary duty against a trustee. (Deschutes Cnty. Cir. Ct.)

Represented plaintiff against hospital in a claim for breach of contract involving a complicated service provision contract. (Arbitration)

Represented plaintiff medical billing company against software developer for breach of contract and negligence. Jury verdict for plaintiff. (Multnomah Cnty. (Or.) Cir. Ct. 2006)

Obtained judgment in favor of defendant issuer against securities fraud claim arising out of FCC auction of licenses to mobile telephone company in Puerto Rico. Resulted in judgment for our client. (Multnomah Cnty. (Or.) 2005)

Represented plaintiff in a multimillion-dollar misappropriation of trade secrets and unfair competition case. (D. Or.)
