Sarah Bhagwandin practices employee benefits law, advising clients on the design and administration of tax-qualified retirement plans, 403(b) plans, health and welfare plans including Section 125 flexible benefit plans, and executive compensation including 457(b) and 457(f) plans. Sarah works extensively with health and welfare plan sponsors on ERISA, COBRA, and HIPAA, as well as other compliance issues that arise in such arrangements. Sarah has guided clients through voluntary and self-correction of compliance failures. She is a frequent speaker on a range of topics, including health care reform, fiduciary duties and liability, the HIPAA privacy and security rules, and COBRA compliance.

Representative Experience

Defined contribution plans

Advises clients on the design and administration of 401(k) plans, 403(b) plans, profit sharing and money purchase pension plans; drafts plan documents, amendments, summary plan descriptions and related documentation; reviews related administrative service agreements. Represents clients in DOL and IRS audits, and advises on self-correction and Voluntary Compliance Program applications.

Health and welfare plans

Drafts health and welfare plans, wrap documents, cafeteria plans and summary plan descriptions. Reviews and negotiates service provider contracts, including business associate agreements. Regularly advises clients regarding administration and compliance issues under ERISA, the Internal Revenue Code, COBRA, HIPAA, and the Affordable Care Act.

Compensation plans

Designs, drafts, and advises on the implementation and administration of 457(b) and 457(f) plans for executives of nonprofit clients.
