Sheehan Sullivan Weiss focuses her practice on employment litigation. She litigates discrimination, harassment, wrongful discharge, wage and hour, noncompetition, and breach of contract cases. Sheehan possesses a successful track record defending companies in employment class actions. She represents employers through all stages of pre-litigation and litigation, including dispute resolution and trial.

Sheehan also counsels employers on how they can minimize their risk for litigation by helping them implement proactive employment practices and policies. She has a bevy of experience advising employers on ADA and disability accommodation issues, and defending them in disability discrimination litigation when necessary.

Class Action Litigation

Sampson et al v. JELD-WEN, Inc.

Prevailed on summary judgment motion against four defendants alleging wrongful withholding of contractually guaranteed bonus payments. Plaintiffs had brought a putative class action on behalf of all similarly situated managers in multiple production plants across Washington state.  Case is currently on appeal. (Ongoing)

Cody Tolliver, et al. v. Avvo Inc.

Defending Avvo in a misclassification wage and hour class action. (Ongoing)

Anderson, et al. v. Boeing Company

Defended Boeing in a case in which a longtime engineer accused the company of failing to accommodate his bipolar disorder, despite the fact that during a three-year period, Boeing provided at least three leaves of absence and the accommodations that the employee requested. After an eight-day trial, the jury returned a complete defense verdict in favor of Boeing on all claims. Case No. 2:15-cv-01860-TSZ (W.D. Wash. 2016)

Defended Cobalt Mortgage in multiple wage and hour class actions

Reached favorable settlements in three class actions after protracted litigation. Cases alleged off-the-clock work violations for mortgage loan officers and supporting employees. (2016)

Kirchoff v. Wipro, Inc.

Won summary judgment in nationwide wage and hour class action case brought by former manager alleging Wipro improperly prorated first and last weeks’ pay under FLSA and state minimum wage laws. (W.D. Wash. 2012)

JPMorgan Chase Bank N.A. v. Bach, et al.

Represented bank against 16 former mortgage loan officers pursuing claims including breach of fiduciary duties, breach of nonsolicitation and nondisclosure agreements, and violations of the Uniform Trade Secrets Act, RICO, and Computer Fraud and Abuse Act. Obtained temporary restraining order preventing solicitation of customers and requiring the return of all confidential information. Settled after obtaining multiple extensions of TRO. (W.D. Tracey Allen v. Group Health Cooperative

Obtained summary judgment on behalf of large health care provider in case alleging discrimination based on race, age, and religion. (2016)

Burrer v. Boeing

Obtained complete summary judgment from federal district court in favor of aerospace company on claims of wrongful termination in violation of the Family Medical Leave Act. (2016)

Howery v. Boeing

Obtained early dismissal in federal court in case alleging violation of the ADA. (2016)

McDaniels v. Group Health Cooperative

Secured summary judgment in wrongful termination case asserting state and federal claims including race, age, and disability discrimination, harassment, failure to accommodate, FMLA interference, wrongful discharge in violation of public policy, and negligent supervision. (W.D. Wash. 2014)

Shelley v. Bank of America, N.A.

Won summary judgment on federal court action for age discrimination and retaliation. (2011)

Williams v. BOSE Corporation, et al.

A former employee claimed his supervisor made racially offensive comments and jokes during the 18 months they worked together. He sued both the supervisor and the company claiming, among other things, discrimination, retaliation and a racially hostile work environment. He claimed he suffered severe and permanent physical and mental injuries as a result of the allegedly improper behavior in the range of $1.5 million to $3 million.

Prior to trial, defense counsel won summary judgment on five of plaintiff's six claims. After a seven-day jury trial on the one remaining claim of hostile work environment, defense counsel obtained a complete defense verdict. No. 08-2-17049-7 May 2010 (King Cnty. (Wash.) Super. Ct. 2010).

Seattle v. Wilson

Represented, pro bono, individuals charged with trespass after they built a homeless tent city on Seattle property. Representation included filing a motion to dismiss based on First Amendment grounds. The City of Seattle subsequently dismissed charges against the defendants. (2009)

Dent and Strathmann v. CombiMatrix

Represented biotech company in defense of claims brought by former vice president of research and development and vice president of marketing seeking multimillion-dollar damages for bonuses and commissions and also asserting patent and intellectual property claims. Claims dismissed following two-week trial. (2008)

Chu v. Russell Investments

Summary judgment granted on federal court action for wrongful discharge, racial discrimination, and constitutional claims. (2006)

Hardage v. CBS Inc., et al.

Obtained summary judgment for employer in harassment and retaliation case, and prevailed on appeal in the 9th Circuit. 427 F.3d 1177 (9th Cir. 2005)

Employment Counseling

ADA committee for Fortune 100 company

Serves as coordinating counsel representative on the ADA committee, advising on accommodation compliance matters nationwide for a company with over 400,000 employees. (Ongoing)

Wage and hour audit for Fortune 100 company

Conducted large-scale exempt status review for Fortune 100 company involving more than 150 positions nationwide. (2017)
