Christopher Zyda 2006 Lead counsel to Amazon EVP Finance, successfully defended against enforcement of noncompetition agreement in executive’s move to eBay. Allwall Technologies, Inc. 2004 Counsel to Allwall Technologies, an Internet art vendor, in copyright infringement litigation. 1-800-CONTACTS 2002 Obtained injunction against infringing television advertising on behalf of 1-800-CONTACTS. Human Kinetics Publishers, Inc. 2000 Counsel to Human Kinetics Publishers, Inc.; obtained dismissal of copyright infringement claims relating to a leading volleyball textbook. NuSkin, Inc. 2000 Counsel to retailer; successfully defended NuSkin’s right to use the trademark “Lifepack” against a claim of infringement brought by Physio-Control. The case involved successful defense of a preliminary injunction motion, dismissal of the claims on summary judgment, and affirmation on appeal. Barnes and Noble 1999 Co-counsel to Barnes and Noble in the “One-Click” patent infringement case. PHAMIS, Inc 1998 Counsel to health care information systems vendor, PHAMIS, Inc.; six-week bench trial of computer software trade secret claims resulted in judgment of dismissal. Plaintiff’s damage claim was $82 million. Costco Wholesale Corporation 1997 Counsel to Costco in litigation successfully enforcing trademark rights. Costco Wholesale Corporation 1997 Successfully defended Costco’s right to obtain and sell bicycles over the objection of the manufacturer and trademark holder of the products.
