Recognizing HIT's importance, DWT has formed relationships
with major players in the development of HIT. For example,
- DWT is principal counsel for The California HealthCare Foundation
and The California Endowment, statewide health foundations in
connection with governance and data privacy projects related to
their single point of entry benefits application software.
- DWT is principal outside counsel for the National Alliance
for Health Information Technology, a diverse partnership of leaders
from all health care sectors working to leverage technology to
achieve measurable improvements in patient safety, quality and
efficiency. For The Alliance, we are addressing organizational
structure models, necessary legislation to enable community networks
and procurement templates.
- For state government agencies, such as the Medicaid management
information system for the state of Washington, DWT negotiates
and documents agreements for the purchase of large information
technology systems and associated services, or for the outsourcing
of systems operations.

Implementation of health information sharing networks will require
individuals and organizations in the health care field to acquire
new hardware and software or to modify existing technology. DWT
has represented buyers and vendors in hundreds of these transactions.
We use this experience during the negotiating process to identify
and defuse problems, thereby significantly reducing the risk of
system failures and costly disputes. Yet when disputes arise,
we know how to resolve them in an effective, cost-efficient manner.

DWT has a strong, national health law practice. We have played
a leadership role in interpreting state and federal health care
regulations, including the "Stark" restrictions on self-interested
referrals, state and federal anti-kickback laws and the HIPAA privacy
and security standards. We have been a major sponsor of and have
provided faculty for the HIPAA Summit Conference Series, www.HIPAASummit.com,
and the HIT Summit, www.HITSummit.com.
In addition, we've been involved in a variety of telemedicine and
electronic records projects, such as an ongoing project funded by
the Robert Wood Johnson Foundation that's designed to create patient-centric
electronically shared care plans and medication lists.
DWT also has a large information technology practice, focusing
on technology acquisition and licensing for enterprises within and
outside health care, including state governments and publicly-traded
companies. The combined expertise of this and our health care practice
qualifies us to help clients resolve the numerous business and legal
issues created by HIT.
