Introduction

Davis Wright Tremaine engages in the general practice of government contracts law. This includes the negotiation and review of contracts and proposals; the litigation of bid protests and contract disputes before the General Accounting Office, Boards of Contract Appeals, the United States District Courts, the Court of Federal Claims (formerly the Claims Court) and the Court of Appeals for the Federal Circuit; the negotiation and reinstatement of debarred or suspended contractors; the preparation of rulemaking comments and Congressional testimony; and representation on matters such as indemnification for ultra hazardous or nuclear activities and foreign ownership, control or influence (FOCI) requirements.

Representative Matters

Successful action on behalf of a contractor for a breach of a teaming agreement in connection with a $100 million systems acquisition by the government.

Successful defense of a contractor in a $150 million qui tam action alleging overcharges in sales of flight simulators to the military.

Successful defense of a government contractor threatened with debarment and criminal prosecution.

Successful action on behalf of a contractor for numerous claims arising out of a contract for the installation and construction of a computerized, automated material handling system for the Defense Logistics Agency.

Representation of several Department of Energy (DOE) management and operating (M&O) contractors in various matters, including a contract administration, feasibility of costs, and compliance with DOE acquisition regulations and labor, environmental and safety standards.

Representation of three DOE M&O contractors in contract transitions.

Representation of proxy companies established to comply with FOCI requirements.

Representation of contractors in legislative and administrative efforts to clarify environmental risk-sharing provisions.
