Employee Benefits
Members of the firm's employee benefits practice group work with
health care providers, purchasers and payers in designing and implementing
qualifying retirement and other benefit plans. Practice group members
structure plans to maximize tax advantages, assure reasonable cost
and comply with applicable federal laws and regulations. Rules governing
controlled groups and affiliated service groups are of particular
concern in the development of integrated health care delivery systems.
Failure to comply with these rules can have disastrous results for
the health care providers and the qualified plans of affiliated physicians
if such plans are aggregated under ERISA and found to discriminate
against lesser-paid employees.
Group members also draft plan documents, handle IRS determination letter filings and advise on fiduciary responsibility issues. The group has extensive experience in all forms of employee benefits, including nonqualified deferred compensation plans, split dollar life insurance, Code Section 403(b) tax-sheltered annuities, Section 457 deferred compensation plans, and all forms of flexible benefit, health, life, long-term disability, and similar welfare benefit programs.
