Public Entity Law
Public, district and university hospitals, state medical schools
and certain related faculty practice plans are special governmental
units that provide health care services or engage in medical education
or clinical research. In representing these entities, the firm's
attorneys must address the special issues raised by their status
as governmental units, as well as the issues facing health care providers.
Public entity status brings with it certain rewards (typically the
power to tax), but subjects the provider to the obligations of a
governmental unit, such as constitutional prohibitions against misappropriation
of public funds, the requirements of "sunshine laws" and other disclosure,
referendum and public bid requirements.
