Introduction
Public finance has become substantially more
complex in recent years as government regulations play an increasingly
large role in all aspects of the issuance process. In addition, new
financing methods are continually being created to accomplish specific
public needs.
Davis Wright Tremaine's Municipal Finance
Practice includes lawyers with extensive experience in public finance
matters of all kinds and, as needed, receives support from lawyers
in several of our other related areas such as securities, tax, environment,
creditors rights and real property.
We have served as bond counsel on virtually
every type of municipal obligation authorized in the States of Idaho
and Oregon, and for issues in principal amounts from a few thousand
dollars to several hundred million dollars. We also have served
as bond counsel to the State of Alaska and are involved in tax-exempt
financing in Washington, California and other states. On issues
where we are not acting as bond counsel, we often serve as trustee,
underwriter and special bank counsel.

Davis Wright Tremaine performs all the customary services of municipal
bond counsel, such as preparation of the proceedings and documents
necessary to authorize the issuance and sale of the bonds, including
all bond election proceedings, coordination with fiscal advisers and
underwriters, attendance at meetings of the governing body and staff
as requested, review of both the preliminary and final official statements,
and advice to the issuer and its financial consultants on all aspects
of the bond issuance and sale, including the impact of federal tax
laws and other federal legislation. Davis Wright Tremaine assists
in structuring the proposed issue to provide a financing which has
minimally burdensome accounting requirements under federal arbitrage
rebate and yield restriction rules, supervises the preparation and
printing of the bonds, and provides the necessary opinion of bond
counsel as to the validity and tax-exempt status of the bonds.
Fees
Our fees for bond counsel services are proportional both to the
complexity of an issue and its size. Davis Wright Tremaine strives
to be competitive and fair by quoting fees for bond issues in advance
and charging the stated fee, plus actual out-of-pocket expenses.
