Supreme Court Issues Landmark
Internet Copyright Decision in Grokster

Earlier today, the United States Supreme Court issued
a landmark decision in the Grokster peer-to-peer filing sharing
case. In an unanimous opinion (9-0) authored by Justice David H.Souter,
the Court reversed the Ninth Circuit's decision that had affirmed
a summary judgment motion filed by defendants Grokster and StreamCast,
holding that Internet file-sharing services can be held responsible
for distributing software that is intended primarily for use by
customers to swap music and movies illegally. The Supreme Court's
decision sends the case back to lower court, with an instruction
that the district court revisit the summary judgment motion that
had been filed by the plaintiff studios, record labels, and music
publishers.
The decision establishes a broad and favorable understanding
of the law of inducing copyright infringement. Specifically, the
Court held that "one who distributes a device with the object
of promoting its use to infringe copyright, as shown by clear expression
or other affirmative steps taken to foster infringement, is liable
for the resulting acts of infringement by third parties." Moreover,
the Court acknowledged that plaintiffs may rely on circumstantial
evidence to prove the requisite intent.
The Court left open the possibility that other bases
for liability also might exist.
