Wind power capacity across the globe has tripled since 2009, and the United States is a leader in this international effort. The US has seen a 31% increase in new wind-generated capacity installed over the last five years, with an average annual investment of $15B in these new wind projects. In 2014 alone, 1,780 new wind projects with a generating capacity of 3,600 MW were installed – bringing the national cumulative generating capacity to 61,327 MW. Today, 39 states (and Puerto Rico) are operating utility-scale wind energy projects. With the United States’ wind-generated capacity expected to continue growing more than 11.0% in each of the next two years, our energy team continues to be at the forefront of this massive shift towards wind energy as well as other forms of renewable electricity generation.

Members of our energy practice have been involved in the development and financing of numerous wind power projects and have assisted clients in every stage of wind project development, including:

  • Transaction structuring to utilize available federal and state tax incentives
  • Advising on the acquisition and divestiture of project assets
  • Negotiating power purchase agreements, transmission agreements, interconnection agreements and sales of environmental attributes
  • Negotiating wind leases, easements and other real estate documents
  • Negotiating turbine supply contracts, balance of plant construction contracts, operation and maintenance agreements, and turbine service contracts
  • Negotiating loan and security documents
  • Advising on federal and state energy regulatory matters
  • Advising on environmental permitting, compliance and land use matters
