Outside the procurement and litigation realms, we counsel clients on government contract issues regarding policymaking, including preparing rulemaking comments and congressional testimony. (Ongoing) Representing master developer in Issaquah Highlands Development Agreement and infrastructure (new Sunset I-90 Interchange; regional water line) for 2,200-acre master plan community in Issaquah, Wash. (Ongoing) Relocation of BNSF Railway track and preparation of 150-acre riverfront site for mixed-use development. (Ongoing) Represented Intuit Inc. and Guardian Industries in obtaining Major Industrial Development designation under Comprehensive Plan, along with annexation and land purchase for new industrial sites in Grant County, Wash. (2008) Represented protestor before the General Accounting Office and Court of Federal Claims relating to procurement of $100 million helicopter services contract in the Pacific for vertical replenishment services for the Military Sealift Command. Obtained positive merits decision before Court of Federal Claims, Geo-Seis Helicopters, Inc. v. United States, 77 Fed. Cl. 633 (2007), and award of EAJA attorneys’ fees, Geo-Seis Helicopters, Inc. v. United States, 2007 WL 3299024 (Fed. Cl. Oct. 31, 2007). Represented owner during the design and construction activities for a $75 million renovation of a historical landmark in New York City. Drafted custom bid documents and construction contracts. Drafted and negotiated general contractor-construction manager agreement. (2006) Representation of successful bidder for $30 million claims management contract in State of Alaska, Office of Administrative Hearings appeal proceeding. (2006) Represented state agency in the matter of a Medicaid Management Information System contract, against a bidder who believed it was wrongly passed over. The court upheld the award to the bidder chosen by the state. (Thurston Cnty. (Wash.) Super. Ct. 2005) Represented awardee in agency, Department of Administration and Superior Court protest challenges involving contract for fixed wing firefighting services.
