Representative Engagements
Using our experience in both civil and criminal
litigation, we have represented a number of clients in "parallel proceedings"
in criminal, civil and administrative forums. We have negotiated "global"
dispositions of several such matters involving multiple governmental
agencies. Our most recent cases include the following:
- Criminal defense of parties prosecuted
under environmental statutes, including matters brought under
the federal and state CERCLA, RCRA, and RICO statutes; Criminal
defense of parties accused of health care fraud;
- Criminal defense of parties accused of
financial institutions and securities fraud;
- Representation of clients accused of
federal program fraud, including procurement fraud, before grand
juries, federal courts, and debarment agencies.
- Defense of a government contractor in
Florida in a criminal procurement fraud investigation; resolved
by an agreement for pre-trial diversion of the company and no
criminal conviction.
- Representation of an individual in a
grand jury investigation of alleged safety violations at a nuclear
facility; prosecution was declined.
- Ongoing representation of a government
official in criminal investigation of alleged bribery.
- Ongoing representation of a major government
contractor in response to a qui tam complaint.
- Ongoing representation of a former bank
officer in criminal and civil investigations of alleged bank fraud
and securities violations.
- Ongoing representation of a government
contractor in California in a criminal procurement fraud investigation;
related qui tam complaint and wrongful discharge lawsuit have
been dismissed by U.S. District Court.
- Representation of fisheries company in
a grand jury investigation involving alleged violations of the
Lacy and Magnuson Acts.
- Representation of medical professionals
in congressional investigation involving billings of Medicare
for alleged investigation medical devices.
- Representation of medical device manufacturer
in federal court Food & Drug Act forfeiture proceeding.
