DECEMBER 2, 2016 – Elaine R. Albrich, a lawyer with more than a decade of experience helping clients resolve complex land use and permitting issues, has joined Davis Wright Tremaine as counsel in our Portland office.

Albrich focuses her practice on the energy and alcohol beverage industries as well as traditional real estate development and rural economic development opportunities. She comes to the firm from Stoel Rives.

Albrich regularly represents clients in hearings and proceedings before city and county governing bodies, hearings officers, the Land Use Board of Appeals, the Oregon Energy Facility Siting Council, the Oregon Liquor Control Commission, and the Oregon Court of Appeals.

Albrich has helped clients permit over 1,000 MW of renewable energy over the last 10 years. This work has involved resolving jurisdictional issues; advising on complex permitting strategies and interpreting new siting requirements; negotiating good neighbor agreements, noise easements, and mitigation plans; leading settlement talks with local opposition; and defending permit approvals.

Albrich also has a broad land use practice, which includes assisting clients in pre-purchase due diligence for both urban and rural lands, issuing permitting opinions, obtaining conditional use permits and post acknowledgment plan amendments, navigating environmental and greenway reviews, permitting outdoor mass gatherings, and defending permit approvals. She is particularly familiar with permitting activities on agricultural and timber resource lands, including residential development, wineries and cideries, agritourism events, festivals, commercial activities in conjunction with farm use, and other nontraditional uses.

Albrich regularly advises alcoholic beverage manufacturers, retailers, and event venues on regulatory compliance issues for operations including liquor licensing, land use approvals, and local code enforcement. She also prepares operating and venue agreements, production agreements, facility sharing agreements, and other general contracts. She can assist clients in navigating the complexities of operating and selling product in multiple states, including evaluating licensing requirements, sales strategies, and marketing and advertising campaigns.

Albrich received her B.S. and J.D. at the University of Oregon. She serves on the board of the Northwest Cider Association and is vice-chair of Sustainable Northwest.
