Merissa Moeller focuses her practice on environmental and natural resources law.  She brings multi-faceted experience with environmental and land use matters, from her work for state and regional natural resources agencies, the private sector, and the courts. Before joining Davis Wright Tremaine, she served as a judicial clerk for the Oregon Supreme Court and the Oregon Court of Appeals, where she drafted appellate opinions.

Representative Experience

Oregon Water Quality Certification

Representing Idaho Power Company (IPC) Oregon water quality certification proceedings under section 401 of the federal Clean Water Act, wastewater discharge permitting, and water rights associated with relicensing of the Hells Canyon Complex, comprised of three dams on the Snake River (about 1,100 MW of capacity). (Ongoing)

Pasco Landfill parties

Representing clients at the Pasco Landfill, which is the second-highest priority hazardous substance cleanup site in Washington state. The site is listed on the Superfund National Priorities List, and the EPA delegated the lead regulatory role to the State of Washington. Representation includes participation in a large industrial waste area generators group (IWAG) where we participate on the technical committee, and participation in significant contribution litigation taking place in federal district court.
