2020 brought the first publicly disclosed prosecutions under the Eliminating Kickbacks in Recovery Act of 2018 (EKRA), and we expect more to come. Because violation of EKRA could lead to a prison sentence of up to 10 years and fines of up to $200,000, it is crucial that labs and addiction treatment facilities understand how to comply with this law.
In this California Lawyers Association event, DWT counsel Kathryn Edgerton presented best practices for addressing the changes brought about by EKRA, including an explanation of how EKRA prohibits traditional arrangements permitted under the Anti-Kickback Statute (AKS) safe harbors, a discussion on the recent enforcement activity, and an explanation of how labs and addiction treatment facilities can structure their commercial relationships in compliance with EKRA.
